Terms of Service

By registering a business account, submitting an inquiry, placing an order, or otherwise using Fresh House Market's website or services, you confirm that you are authorized to act on behalf of your business and that your business agrees to be bound by these Terms. These Terms constitute a legally binding agreement between your business and Fresh House Market.

Fresh House Market provides B2B fresh produce sourcing, quality-checking, order consolidation, and delivery services to food businesses including restaurants, supermarkets, canteens, hotels, and other food service operators in Kingston, Jamaica and surrounding areas.

Our services include, but are not limited to:

• Fresh produce sourcing from local farmers and suppliers
• Quality inspection and grading of all produce
• Order consolidation and fulfillment
• Scheduled delivery to your business location
• Cold storage and handling where applicable
• Online B2B ordering platform access (upon account approval)

To access our ordering platform and services, you must register a business account. By registering, you agree to:

• Provide accurate, current, and complete information about your business
• Maintain and promptly update your account information
• Keep your account credentials confidential and secure
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including if we believe that your conduct violates these Terms or is harmful to other customers, us, or third parties.

All orders are subject to product availability. Prices are quoted in Jamaican Dollars (JMD) unless otherwise stated and are subject to change without notice. We will make reasonable efforts to notify registered business accounts of significant price changes in advance.

• Minimum Orders: Minimum order quantities or values may apply and will be communicated to you upon account approval.
• Order Confirmation: Orders are not confirmed until you receive written or electronic confirmation from us.
• Order Changes: Changes or cancellations to confirmed orders must be made within the timeframe specified in your account agreement. Late changes may incur fees.
• Seasonal Availability: Fresh produce availability is subject to seasonal and agricultural conditions. We will substitute with comparable products where possible and notify you of any substitutions.

Delivery schedules are agreed upon at the time of account setup. We will make reasonable efforts to deliver on schedule; however, delivery times are estimates and not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control, including weather, traffic, or supplier disruptions.

• You are responsible for ensuring someone is available to receive deliveries at the agreed time and location.
• Risk of loss and title for products pass to you upon delivery.
• Delivery fees, if applicable, will be communicated to you in advance.

We take pride in the quality of our produce. All products are inspected before dispatch. If you receive produce that does not meet the agreed quality standards:

• You must notify us within 24 hours of delivery with photographic evidence of the issue.
• We will investigate and, at our discretion, offer a replacement, credit, or refund for affected items.
• Claims made after 24 hours may not be accepted.
• Returns of perishable goods are generally not accepted unless the product was defective at the time of delivery.

Payment terms are established at the time of account approval and may include cash on delivery, weekly invoicing, or other arrangements as agreed in writing. We reserve the right to:

• Require payment in advance for new accounts or accounts with outstanding balances
• Charge interest on overdue invoices at a rate of 2% per month
• Suspend or terminate service for accounts with overdue balances
• Pursue legal remedies for unpaid debts

All content on our website, including text, graphics, logos, images, and software, is the property of Fresh House Market or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

To the fullest extent permitted by applicable law, Fresh House Market shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of our services.

Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the total amount paid by you to us in the three (3) months preceding the claim.

You agree to indemnify, defend, and hold harmless Fresh House Market and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of our services, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of Jamaica. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Jamaica.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date and, where appropriate, notifying registered business accounts by email. Your continued use of our services after any changes constitutes your acceptance of the new Terms.

Either party may terminate the business relationship with reasonable written notice. We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or if we determine that continued service is not in our best interest. Upon termination, all outstanding balances become immediately due and payable.
